1. Introduction and Agreement to Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “Client,” “you”) and AMO GROUP LLC-FZ (trading as Fund8), a company registered in the United Arab Emirates with Company Registration Number 2307915, located at Meydan Grandstand, 6th Floor, Meydan Road, Nad Al Sheba, Dubai, UAE (“Company,” “we,” “us,” “our”).

By accessing or using the website fund8.io (“Website”), creating an account, or purchasing any services, you expressly acknowledge that you have read, understood, and agree to be bound by these Terms (including the Refund Policy in Section 5, the AML Policy in Section 4, and the Complaints Policy in Section 12) and our separate Privacy Policy.

If you do not agree to these Terms, you must immediately discontinue use of our Services.

2. Eligibility

By using our Services, you represent and warrant that:

  1. Age: You are at least 18 years old.
  2. Capacity: You have the full power and legal authority to enter into this agreement.
  3. Jurisdiction: You are not a resident of any country subject to international sanctions or where the use of our services would be illegal.

3. Description of Services

Fund8 provides educational trading tools, simulated trading environments, and evaluation programs.

3.1 Product Types

  • Simulated Challenges: These accounts utilize purely simulated funds in a demo environment. No real trading takes place, and no real capital is at risk during the evaluation phase.
  • 10X LP Real-Capital Program: This program involves real Decentralized Exchange (DEX) execution. Trading activity is recorded on-chain, and payouts are managed via smart contracts.

4. Account Registration and Security

4.1 Account Creation

You agree to provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your login credentials.

4.2 Know Your Customer (KYC) & AML Policy

Fund8 strictly adheres to Anti-Money Laundering (AML) and Counter-Terrorism Financing (CTF) regulations. We employ measures including, but not limited to:

  • Identity verification and sanctions screening.
  • Web3 wallet analysis and transaction monitoring.
  • Suspicious Activity Reporting (SAR).

We reserve the right to suspend any account that fails to provide requested KYC documentation immediately or if illicit activity is suspected.

5. Payments, Refunds, and Chargebacks

5.1 Payment Processing by Odeonpay ALE S.R.L (“Paysagi”)

All payments, or payments for specific parts or regions, are processed by Odeonpay ALE S.R.L (“Paysagi”) acting as the Merchant of Record (MOR). These payments are subject to Paysagi’s Terms of Use, which can be found at https://paysagi.com/terms-of-use/. Customers will be presented with these terms during the payment process.

5.2 Refund Policy

Because we provide immediate access to digital products and proprietary trading dashboards, all purchases are considered final once access credentials have been delivered.

No refunds will be granted if:

  • A login, dashboard, or trading credential has been issued.
  • The user has commenced any trading activity.
  • The user has breached these Terms of Service.

Exceptions: A refund is only available if the user has purchased a product but has not yet received access, and the request is made within 24 hours of purchase.

5.3 Chargebacks and Disputes

Initiating a chargeback or payment dispute without first contacting our support team is considered a breach of this agreement.

  • Consequence: Any chargeback will result in the immediate termination of your account and the forfeiture of all simulated or funded accounts.
  • Liability: You agree to reimburse Fund8 for all costs incurred in defending against invalid chargebacks, including administrative and legal fees.

6. Trading Rules and Conduct

6.1 Prohibited Practices

To maintain the integrity of our platform, behaviors such as market manipulation, bot abuse, latency arbitrage, and group trading are strictly prohibited.

6.2 10X LP Program Specifics

Participants in the 10X LP Program must adhere to specific risk parameters:

  • Maximum Drawdown (Max DD): 7% of the initial balance.
  • Monthly Profit Target: 4%.
  • Profit Split: 50% distributed via smart contract.
  • Forfeiture: Failure to meet these parameters results in account closure and forfeiture of 30% of the deposit.

7. Intellectual Property Rights

All content on the Fund8 website, including text, graphics, logos, software, trading dashboards, and smart contract code, is the exclusive property of AMO GROUP LLC-FZ or its licensors and is protected by international copyright and trademark laws.

8. Risk Disclosure

Trading in financial markets involves a significant risk of loss. You acknowledge that you are solely responsible for your trading decisions and that past performance is not indicative of future results. For services involving Web3 and on-chain execution, you acknowledge that blockchain transactions are irreversible and Fund8 is not responsible for smart-contract exploits or wallet security breaches.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall AMO GROUP LLC-FZ, its directors, employees, or partners be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your use of the Services.

10. Indemnification

You agree to defend, indemnify, and hold harmless AMO GROUP LLC-FZ from any claims, damages, liabilities, and expenses arising from your use of the Service or breach of these Terms.

11. Third-Party Links and Services

Our Service may contain links to third-party web sites or services (including DEXs, wallets, or payment processors) that are not owned or controlled by Fund8. Fund8 has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.

12. Dispute Resolution and Complaints

12.1 Complaints Policy

If you have a dispute, you must first attempt to resolve it informally by contacting support@fund8.io with your Account ID and evidence.

  • Timeline: We acknowledge complaints within 48 hours and aim to provide a resolution within 7 business days.
  • Finality: Decisions made by our Compliance department regarding trading rule violations are final.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Arab Emirates (Dubai), without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Dubai, UAE.
